patrol agent is dead and another injured after a shooting this morning near noco. that is just south of tucson. authorities say that area is known as a major drug smuggling corridor and the shooting happened just eight miles from the mexican border. the identities of the agents have not been released. the suspect right now is still on the loose and we are following this story very closely and will bring you more detail as we learn them. also in other news, counselors at albany middle school will meet with students this morning about the sudden death of a popular middle school teacher accused of molesting a former student. christie smith is live at albany where a memorial grew overnight for james izumizaki. a loft emotions flying out there, christie. good morning. >> reporter: good morning to you, jon. yeah, this is a tragic end to just a terrible situation. i spoke with one dad off camera. he said that his daughter is a student here and has been home crying since she heard the news.

there are flowers as candles and notes in front of albany middle school this morning. most of the notes seem to be from student athletes, saying they love and miss their coach. the alameda county sheriff says a family member found james izumizaki dead in his car yesterday in san lorenzo. he was just 28 years old. his death being investigated as a suicide. he was a sixth grade teacher here and a volleyball coach, a basketball coach, very popular. students say he always went the extra mile for them. but last week he was arrested, accused of having an inappropriate relationship with a former student. the school will inform the student body today of his death but word is already spreading out there, especially on social media. one former student says he'll encourage mr. i's athletes, that's what they called him, to compete in his honor. >> they're going to have to get through this because he was -- he was a really good coach. he will deeply be missed.

>> reporter: now, he was out on bail and the d.a. didn't file charges against izumizaki because police were still investigating the case. so albany police will really have to decide where this case goes from here. the superintendent of albany school is expected to update the media on this situation at 8:30 this morning. reporting live in albany, christie smith, "today in the bay." the trial for the woman accused of killing nursing student michelle le continues today. during opening statements yesterday, prosecutors allege that 28-year-old gisele esteban killed out of jealousy, hatred and rage. they say esteban blamed le for ruining her relationship with her daughter's father. esteban's attorney did not deny the allegations, admitting there is a mountain of evidence against her client. but she says esteban did not plan to kill le but instead snapped as a result of extreme provocation and the heat of passion. le disappeared from kaiser hospital in hayward in may of 2011.

her body was found 4 months later in a remote area between sunol and pleasanton. the trial is expected to last one month. a big-time change for a south bay staple that's been in business since back in the 1940s. we have a live look at race street foods in san jose, which just announced it's getting out of the wholesale business. the family-own eld business sells poultry and seafood to 2,000 clients in ten bay area cities. now its wholesale celebrations have been -- i should say operations have been sold to houston-based cisco. race street says it will keep its seafood kitchen open. coming up at 6:30, marla tellez will be here live with a report on the reasons behind this shuffle and whether you'll have to go somewhere else to buy your holiday turkey. nurses at a north bay hospital walked off the job about an hour ago. today is day one of a two-day strike for nurses. the strike started at 5:00 this

morning and will end at 5:00 thursday morning. union leaders say recent pay cuts and wage disagreements are at the center of it all. the hospital says hundreds of replacement nurses have been brought in to keep the hospital open during that strike. >> and we have been feeling it here and hot temperatures across the state prompted concerns about a possible drought. national weather officials say 69% of the state is considered to be in moderate drought conditions and that is expected to get worse through december. the state's major reservoirs are below average storage leveling right now of the california barely avoided a drought because those reservoirs were filled with water from early months of 2011 but that surplus now is nearly gone. and while the stubborn heat is gripping the state it's expected to ease up but right now there isn't much rain in the forecast. although christina tells us maybe a little. >> not today. the heat is coming again. good morning to you, jon and

laura. good morning to you at home. i wanted to start with this live picture of san jose. we have moderate air quality. we have improved in that department and you will notice that better visibility as we head throughout this afternoon, but another clear start. sun blazing in early means it's going to be a hot day. we're in the 50s and 60s all across the board except for south bay and east bay valleys where we enjoy 70s to start. not all that pleasant in pleasanton today. it's nice but temperatures are going to exceed the century mark out in the east bay in the hottest cities yet again. so it all works out like this. starting to get a little too hot for your outdoor plans at 10:00, 11:00 a.m. inland today. so take care of those activities early. 80 degrees at noon by the bay. not a whole lot of separation in your temperatures. we always get a lot of separation because of the marine influence and low clouds that hug the coast. that's not going to be the case today. in fact that marine layer will be way out to see. you won't even be able to see it

standing on the beach. it's going to be hot and hazy today. as we head through the end of the week we take your temperatures down 25 to 30 degrees and bring in clouds and showers. so the seven-day forecast we'll get for you coming up. first, maybe you're ready to head to work. here's mike to help you out. >> whenever you're driving, we've got a lot of folks joining you. we have the bay bridge toll plaza, the cash lanes backed up. fastrak still an advantage but not for long. it's traffic tuesday, folks. look at the maps and we'll show you what's going on. the approach moving smoothly. still a little slowing because of the volume of the east shore freeway. but eastbound 24, getting a little slow as you approach because of a disabled motorcycle reported in the slow lane, but crews should be there to help him shortly. just be careful coming around the bend. westbound your commute shows slowing because of the volume. west 580 for the altamont pass slowing all the way in and

through livermore, slowing over towards isabel. the earlier debris cleared from airway, that's good news. a live look shows you san jose north 101 slows right here from tully up toward 880. that's still the only major slowing but we're starting to build all throughout the south bay so we'll show that to you coming up, devise. back to you. oh, yeah, here we go. they are on fire, the a's putting the a in the playoffs. they make it official, they'll be playing in the postseason. >> swing and a miss! he struck him out, and the oakland athletics are going to the postseason! unbelievable! >> oh, yeah, you can believe it now, though. it's been a magical season for the unlikely playoff contenders who haven't been to the po postseason in six years. they beat the rangers last night to clinch the playoff spot.

house of the america's cup village which is just on the other side of marina green between marina green and crissy field. this is where the central area will be for spectators this week who are trying to see the ac-45s, those 45-foot-long catamarans out there competing this week in the america's cup world series. all the while fleet week is going on so you have two major events on the bay this week. jenny, who is actually a sailor herself, you actually competed out here a week or two ago. the conditions are probably similar then as they are now. what should people expect this week as far as what they'll see out there? >> we're actually hoping for beautiful weather this week. for the racing, it will be a little lighter than this summer, a little more pleasant for the people on shore watching from the village, not nearly as cold, not nearly as windy but still great racing. they probably won't get up to 30 knots but we'll see them at 20 which is a phenomenal speed. >> reporter: when the america's

cup comes here next summer, ac-72s, you've seen those out on the bay practicing recently, which has been new. what are those like compared to the 45s? >> these boats are incredible. we saw oracle's boat out practicing yesterday. we'll see them again today in the 72. it is phenomenal. it is foiling, which means the entire boat lifts out of the water and just has tiny foils underneath that are only about this long, so the whole boat, it's like it's hovering over the water. it's really great. it will be really neat to see them all out next summer. >> reporter: best bet for people that want to come out and see what's happening today with the practices, the qualifying tomorrow, the competitions throughout the week. you can come out to marina green. they have ana online a -- appd they have made this into a very fan friendly event.

facebook. when you click a like button on a news article or picture somewhere else on the internet, facebook still keeps that data. that's a problem if the person doing the clicking is under 13. the children's online privacy protection act says you can't record what kids are doing online. so in a letter this morning facebook wants the justice department to consider the "like" button part of a free speech right instead of just a way to collect data. now, the irony in all this is kids under 13 aren't allowed on facebook in the first place but facebook is realistic here. it doesn't want kids as members but it knows it has kids as members and it is collecting that data. for right now that's contrary to the law. russian prime minister dmitry medvedev welcoming facebook head mark zuckerberg to moscow yesterday. today zuckerberg will lecture at moscow state university. russia has a growing i.t. industry. in fact some of the biggest

investors are russian. and this woman, janet napolitano, is in charge of american cyber security and the internet world scratching its collective head this morning after an interview on cnn where secretary of homeland security napolitano says she doesn't use e-mail because she's worried it's insecure. to be sure she works in perhaps the most sensitive office in all of american government so maybe it makes sense. but the lady in charge of making sure your e-mail is secure says she doesn't use. >> it doesn't that say something in itself? >> what if she got hacked, you know? that wouldn't be didn't. right now we're talking some weather. safe to say it's going to be hot. >> oh, it is going to be hot. good morning to you. i want to thank you for waking up with us each and every morning. we've got a major swing in your temperatures. we want to start with this live picture. old glory there blowing in the breeze. it's going to be jam-packed in san francisco this weekend. america's cup, fleet week and of course the giants playoffs. two games at home, saturday and

sunday. ladies, that means if you're single, head to the city, head to the city this weekend. temperatures are looking good, san jose a beautiful start out here at 6:18 now. as you're making your way out that front door just make sure you're ready for another day of very hot weather similar to yesterday. some cities are going to be just about as hot. i think the coastal cities will be a touch cooler. san jose actually hit 96 degrees, 103 out in gilroy and we are mild to start which is why i do believe it's going to be another hot one. upper 50s to start. 64 in san jose, 63 degrees, good morning, in san francisco and 52 degrees out in novato. now, high pressure is the driving portion behind this warmup driving those winds out to see sea, pushing that marine layer way out to the pacific. fire danger elevated again today, 10 to 15 degrees above average but we have improved air quality. so if you don't have ac in your home as many who live pie the water do not, go ahead and feel free to open up those windows

with a good conscience. cooling breeze arrives. it just blows my mind how different the weather is going to be as we meet back here on thursday and friday morning. 20 to 25-degree dropoff. patchy fog and drizzle returns and those winds shift back out of the west so that means that marine layer air will cool us down and we've got a little low pressure carrying some very cold air with it and some moisture, potentially bringing us our first showers of the season looking likely on sunday. 102 in livermore, temperatures staying just about as hot today as yesterday bayside and at the coast. 10 degrees cooler tomorrow, 10 degrees cooler through thursday and then the 70s arrive as we head through the weekend. cloudy, winter-like weather sunday into monday. let's find out how your drive is shaping up with mike. >> good morning, folks. anything north of san jose into sunnyvale, mountain view, palo alto looking pretty good. the volume just building for 101. 280 not a problem. 101 through san jose starts to slow right around the area just north of capital expressway and

continuing up toward the 101 and 87 merge here just by the airport. 87 also shows slowing but pretty gradual build. watch the next 40 minutes and this will change dramatically as far as the color makeup of this map. it will look more like this over at the castro valley y. very slow approaching north 238 and heading south on 880 as this is the volume. that's a big slow spot that's been forming the last couple of weeks. we always have this slow spot west 580 coming out of the altamont pass. speeds into the 50s and getting down into the 40s at times. good stuff, though. 880 building the volume past high street toward the bay bridge toll plaza. no slowing through oakland until you get to the overcrossing. there's an accident approaching the bay bridge. it is actually going to be an issue. you might be sticking to the slow lanes. there are the metering lights and we'll look at sfo as well

because you can clearly see no fog. back to you. >> thank you very much. it is 6:21 right now. palo alto may be cutting back on garbage trucks citywide. the city right now working on a way to keep organic waste out of landfills. the city says if homeowners sorted their food scraps, there would be less trash and less need for trash pickups. palo alto is already trying to implement a sorting program. tonight the city's finance committee is expected to look into reducing garbage collection to once or twice a month or possibly getting rid of it entirely. 6:21. coming up, decision 2012 behind closed doors. the last-minute rehearsals before tomorrow night's big presidential debate. we'll tell you where the candidates are today and what they're planning to say to try to sway your vote ahead in a live report. i moved to new york to work in fashion.

voters are actually starting to go to the polls in some of these key states. early balloting starts today in the all-important swing state of ohio and really the candidates are hoping to do two things. they're hoping to score some points on the other guy but also avoid those gotcha moments, those just subtle phrases or a sigh or weird body english that could just decide which way one voter or another is going to fall in one of those key states. well, the candidates have been preparing, preparing, preparing, getting their messages honed down to a fine edge. here is how they want tomorrow night to go. >> it will be a conversation with the american people that will span almost an entire month. we'll get to describe our respective views. >> it's a choice between two different paths for this country. it's a choice between two fundamentally different visions for our nation. >> reporter: again, it may look like they're talking at each other or talking to the american people, but in fact they're trying to reach that dwindling

and there you have it. we take you live to the new york stock exchange. there's the opening bell on this tuesday. they're feeling the energy out there. october 2nd. this is "today in the bay." good morning, everybody. it is 6:30. i'm jon kelley. >> and i'm laura garcia-cannon. this morning our october heat wave continues with warm temperatures expected throughout the bay area. the heat is being blamed for an elderly woman's death in the east bay and today that woman's son is traveling from virginia to the east bay to demand answers. 86-year-old yolanda membreno was found dead in 100-degree heat at pleasant hill elementary school after wandering away from a cop cord nursing home on sunday. caretakers noticed she was missing at 4:30 in the afternoon and searched on their own for

about an hour before calling police. a police dog eventually traced her scent to fair oaks elementary school about 100 yards away from the facility. the family says the home told them she died of a heart attack in her sleep. the home denies saying any such thing. all this hot weather is also causing one south bay park to shut down. san jose's alum rock park to be safe will be closed today. this is due to possible extreme fire conditions and they also want to reduce any chance of fire emergencies. that closure will last for only one day. with a look at the weather warmup we're talking about and whether those temperatures will continue to rise, let's check in with meteorologist christina loren. >> last day of triple-digit heat. good morning to you. i want to start with the reason for the warmup. offshore flow pushing that marine layer way out to sea. no fog, no low cloud cover to cool us off. taking a live look over the way, just spectacular conditions. if you can get to the water

today, the beach is the place to be. temperatures are mild to start. in fact we're running 5 to 8 degrees warmer up in santa rosa and novato. 61 to start you out in san mateo. we're already at 64 degrees right here in san jose with some of your east bay cities starting out in the 70s. you're at room temperature right now in danville, 72 there, and walnut creek. as we head throughout the day today, by noon it will be a little too warm for your outdoor plans. if you don't have ac and are suffering from the heat, the good news is you can feel free to open up your windows today. we do not have unhealthy levels of pollutant to deal with. our air quality is improving. as of tomorrow we'll take off ten degrees from today's highs. 102 in livermore, 93 in san jose, 83 in san francisco and 91 degrees again in oakland. it's going to be hot out there. beautiful sunrise to drive to work with, though, mike. >> you said head to the beach. well, walter's edge. bay bridge toll plaza, a lot of folks hanging out here because they have to. they've to squeeze through this area.

the backup past the 880 overcrossing. the map will show you the better news. the accident has cleared coming off of the 880 interchange but slowing from the top of your screen down off the east shore freeway in your commute direction. no problems out of the caldecott. a little slowing north 880 coming up through the earlier construction zone which should be cleared in the next few. we'll take a live look outside and show you how things are shaping up across the bay. 92 has had a tough drive for the last five work days, since last week, so expect another tough commute westbound. dumb barton bridge a little clearer. we'll end with another live look out here at the south bay. san jose picks up the volume. we'll show you the extent of the slowing coming up in the next report. a scary discovery for a bay area family after they find the body of a missing boater right on the shoreline near pigeon point. the coast guard says the family of the missing men were

searching for these gentlemen. they found this gentleman on their own when his body was found just yesterday. the men had been missing since sunday when the boat capsized during a fishing trip with friends. he and another man, who is still missing, were not wearing their life jackets. the two other fishermen were wearing life jackets and they both were able to swim safely to shore. 6:34. in the east bay firefighters laid off earlier this year could soon be back on the job. the east contra costa fire district receiving nearly $8 million in federal grants. it means 15 positions that were originally cut will now be filled. fire officials say they'll also hire an additional dozen people an three fire stations that were closed due to budget cuts will now be reopened. a long-time family run market which has served the bay area over six decades will soon be closing its doors for good. marla tellez is live in san jose with a look at the race street fish market closure.

a lot going on out there. >> reporter: it's pretty sad, jon. good morning to you. from experience i can tell you that the fresh food that you're going to find here at race street fish and poultry are hard to beat. i've cooked up some of their salmon and halibut, it is tasty, i can tell you that much. race street has been around since 1947, but this old-fashioned market counter that you see right here, this is going to be closed in just 12 days. after 65 years, its four owners, all second generation family members, say it is simply time to retire. this means that thousands of customers will have to find another place to buy their turkey this thanksgiving or their fresh dungeoness crab come christmas. they told the wholesale portion to a corporation based in texas. >> it's going to be bittersweet. i'm past retirement age. i'm happy to be able to retire. on the other hand, i'm going to

be sad that the family business will be no more. >> they can't, no, no! no, you can't! >> reporter: that customer there, bill, says that he's been coming to race street for his family's christmas dinner for 20 years. he says the holidays are simply never going to be the same. how about some good news. race street says that its seafood kitchen you see right here, this portion is going to stay open. in fact the owners say they are going to expand the kitchen. you can grab fresh lunch or dinner, salads or sandwiches, that sort of thing. so that is the good news. this market will be closed as of october 14th. live in san jose, marla tellez, "today in the bay." >> how about we grab lunch later too, marla. thank you. 6:36. one of the strictest smoking bans in the bay area is now in effect. san rafael officials voted on the new ordinance last night. not only does it ban smoking in apartments and condos, it also pans smoking in public parks, bus stops, restaurant patios and

a. happening right now, six crew members under arrest after a boat packed with people slammed right into a ferry near hong kong. right now 38 people are confirmed dead, including some children. nine people among the 100 rescued are seriously injured. at least one person confirmed missing. that boat was carrying utility workers and their families to victoria harbor to watch fireworks when it collided with the ferry. officers say the crew members arrested here are from both boats. 6:40. new this morning, the pope's former butler is breaking his silence today about why he stole secret documents from the vatican. he will take the stand today on charges of leaking copies of the

6:44. answering to charges. today a court appearance for the man accused of attacking a young girl inside an elementary school bathroom and dragging her off of campus. police say 25-year-old bradley mrozek walked into the parkside elementary school campus in san mateo and grabbed a young student from the bathroom. she managed to fight her way free and she ran to tell school administrators. sense the attack, parkside has installed stronger locks on gates and is enforcing stricter requirements for visitors. first the arrest, now the death of a popular east bay teacher has left the albany middle school community simply stunned. this morning counselors meeting with students and the school board will be giving more details to parents about james izumizaki, accused of molesting a former student. christie smith is live at albany middle school with all the details. christie, good morning. >> reporter: good morning to

you, jon. i spoke with one parent off camera this morning and he told me his daughter is a student here and she's at home crying. the family is in shock. first the horrible accusations and now this news. well, this morning there are candles and flowers and notes left by students, many saying that they will miss their teacher and coach. as you said there's going to be counselors here today and teachers will hold a candlelight vigil at 7:30 until classes start at 8:00 to remember james izumizaki, popular sixth grade teacher and coach found dead in his car yesterday in san lorenzo. now, it's being investigated as a suicide. last week police arrested the 28-year-old on suspicion of lewd conduct with a person under 14, a former female student. parents got a call about the news last night. word is spreading fast on social media. students will be officially informed today, but parents say kids really need to hear the truth. >> you can either make or break

a kid in middle school. and, you know, hopefully this doesn't do any damage to any of the kids. >> reporter: nbc bay area tried to talk about izumizaki but he declined. he was out on bail. now, the d.a. hadn't filed charges against him because police were still investigating. the superintendent of albany schools will be speaking about this at 8:30. for students, it's certainly going to be a very emotional day. reporting live in albany, christie smith, "today in the bay." 6:46. a developing story in the central valley where cleanup crews have been working throughout the night to repair a stretch of tracks after two train crashes just miles apart. yesterday afternoon an amtrak train traveling from oakland to bakersfield derailed near hanford. that's about 30 miles south of fresno. less than four hours later and just 17 miles away, a freight train and a tractor-trailer collided. the driver and two dozen of the 169 people on board were

picture because traditionally you can't make out all the features across the bay. you've got alcatraz, a cruise ship you can see and even the golden gate bridge highly visible this morning. very unusual for an early october morning. traditionally we're socked in with fog. this morning the heat is on. already 63 degrees in san francisco. right around your average high for this time of year. and you can imagine it's going to be another hot day. you hit 90 in the city yesterday and just about as hot today as high pressure is still in control bringing about the dog days of fall. so 10 to 15 degrees above average yet again today. improved air quality. we're now become in the good to moderate range. that will continue to improve as we get a stronger onshore flow starting tomorrow. this system of low pressure tracks closer and closer to the coastline, this low pressure is carrying with it very cold air. in addition to that a lot of moisture. so we're talking about almost hitting summer-like conditions today, right back to winter at the end of the week.

new accident at kurtner going to slow things down further. 85 itself from out of campbell and all the way up toward saratoga, that's the new pattern we've been seeing and it looks like it's here to stay for the south bay. we will look at another live shot outside and see how things are shaping up. southbound 680 moves nicely arnt bend into fremont as the sun comes up. still close to the speed limit through pleasanton, but livermore, all those folks coming out of the tri-valley will make this slower over the next 40 minutes as well. we continue with live shots showing you the toll plaza. the backup making its way back to the maze. another thing unusual for the east shore freeway other than typical slowing out of richmond and down to the berkeley curve. we'll show you the peninsula north 101 smooth drive but starting to build with the company from willow up into san mateo. the southbound side also building as the sun comes up. you'll see the slowing. are you ready for this?

boats on the water, blue angels in the sky. it's going to be a busy weekend in san francisco. a bold understatement. >> no kidding. thousands are expected to flock to the marina green for another round of the america's cup world series. practice actually gets under way later today. >> that is right. bob redell is the captain of this live shot and is in san francisco right now with more on what's going on. hey, bob. >> reporter: ahoy. good morning to you, jon and laura. yes, we were talking about the ac-45s. these are 45-foot-long catamarans out on the bay starting today for practice for the america's cup, a world series competition and qualifying starts tomorrow, runs through sunday. now, those are catamarans. back in the day, they used to rate on mono hulls and in 1851 it was a yacht called the america that won a race around england that kicked off the america's cup. right now we're on a replica of that ship. it's 138-feet long. the tallest mast 105 feet tall and its skipper, this gentleman right here, troy sears, has

owned this boat the past seven years. i'm trying to get a sense of your passion, your enjoyment of sailing an being out here compared to what you see out there today with these ac-45s. >> i think it's always been fantastic. for me i started as a young.. i have over 7,000 days on the water and 250 days a year of them are on this boat. >> reporter: and you acquired it from someone else. you said it's like your second home away from home? >> it absolutely is. all our family vacations are here. our last six thanksgiving dinners have been on this boat. >> reporter: you say you've been watching the america's cup live since '87. what can people expect when they're out here watching the competition on the bay? >> it's really made a big change by coming here to san francisco because the venue here in san francisco is so exciting. the ability to see the races right here from the shoreline has really been a fantastic development. and moving to the catamarans have really made the boats so

"today in the bay." a major warning and massive recall on a number of popular peanut butter brands is expanding. new mexico-based sunland now lagd more store brand names into the recall list. they provide peanut butter and other nut products to major chains. some of the brand names include target archer farms, safeway's open nature and fresh & easy. also on the list, nature valley, earth balance and serious food. that recall first started after some people started getting sick after eating trader joe's peanut butter brand centers for disease control and prevention says there are at least 30 cases of salmonella in na19 states. we're also talking about the heat today. breaking some records? >> oh, yeah, we will smash records just like yesterday but the good news is we'll take your temperatures down 10 degrees tomorrow. still staying hot, though, 102 inland today, 90 bayside, 80 at the coast. by friday into saturday, upper 70s inland.
